Term of Service / Agreement1.1 AgreementBy accessing or using the services of Support My Community Fundraising, you agree to these terms in full. This includes our Cookie Policy and Privacy Policy, which outline how your information is collected, utilized, shared, and stored.By creating an account or accessing our platform, you are entering into a legally binding agreement with Support My Community Fundraising, regardless of whether you use third-party login credentials or access the platform on behalf of an organization or personally to shop for gift cards. If you do not agree to these terms (“Agreement” or “User Agreement”), you should not create an account or use any of our services. You can terminate this Agreement at any time by closing your account or profile and ceasing to use the Support My Community Services.1.2 Our ServicesThis Agreement applies to all services offered under Support My Community Fundraising, including our website, mobile applications, plugins, advertisements, e-commerce features and any other tools or features associated with our platform (“Services”). This also includes data collection or advertisements linked to Support My Community Fundraising.1.3 Our OrganizationThis Agreement is between you and Support My Community Fundraising (hereafter referred to as “we,” “us,” or “our”).As either a registered user (“Member”) or an unregistered visitor (“Visitor”) of our platform, you consent to the collection, use of your data under our Privacy Policy and Cookie Policy, which you acknowledge having read and understood.2. Members and VisitorsThis Agreement applies to all users of the platform, including both Members and Visitors.Members: When you register and create an account on Support My Community Fundraising, you become a Member, gaining access to a broader range of services and tools. There are 4 types of Members associated with the Support My Community Fundraising platform. Merchants (Businesses with profiles selling Gift Certificates), Organizations (Non-Profits with profiles raising money for the organizations), Users (Purchasers of Gift Certificates) and Sales Associates (People or Organizations that recruit Businesses or Non-Profits to join the system.Visitors: If you choose not to register, you may still access certain features of our services as a Visitor.3. Updates to this Terme of Service / Agreement3.1 ModificationsWe may occasionally update or revise this Agreement, as well as our Privacy Policy and Cookie Policy. If required by applicable law, or if significant changes are made to the terms, we will notify you through the platform or other appropriate means.Changes will not apply retroactively. If you do not agree to the revised terms, you may close your account. By continuing to use our platform after receiving notice of changes, you agree to be bound by the updated terms from their effective date.4. Obligations4.1 Eligibility to Use Our ServicesBy using Support My Community Fundraising, you agree to the following terms:You meet the required “Minimum Age” of 18 years old.You will only create and use one account on Support My Community Fundraising, registered in your real name.You are not currently restricted or prohibited from using our services.The platform is not intended for individuals under the age of 18. If your jurisdiction requires a higher minimum age for us to provide services lawfully (e.g., without requiring parental consent), you must meet that age requirement. Creating an account using false or misleading information, such as registering on behalf of someone else or for individuals under the age limit, is strictly prohibited and violates our terms.4.2 Your Account ResponsibilitiesAs an account holder / Member you agree to the following:Keep your password confidential and secure.Do not share or transfer your account to others.Abide by all applicable laws, our policies, and the Community Guidelines outlined below.You are responsible for any activity that occurs under your account, except in cases where you’ve reported unauthorized access or misuse. Your account is personal to you, even if access to certain services (e.g., premium features) has been paid for by a third party, such as an employer or affiliation with another organization. While the paying party may manage access or receive usage reports for these paid services, they do not own or control your personal account.4.3 PaymentsIf you purchase paid services or agree to sell and or buy Gift Certificates through Support My Community Fundraising, you agree to the following terms:You are responsible for paying (If applicable) all fees and taxes.Any payments may include additional costs such as foreign exchange fees or price variations based on location (e.g., exchange rates)..You can update your payment method or access your purchase history and invoices through your account settings.4.4 Communication and NotificationsYou agree that we may send you notices and messages in the following ways:Through the Support My Community Fundraising platform (e.g., notifications on the website or app).Using the contact details you have provided, such as email, phone number, or physical address.It is your responsibility to keep your contact information current to avoid missing important updates. You can adjust your communication preferences in your account settings to control the types of messages you receive.4.5 Sharing InformationWhen you share information on Support My Community Fundraising, you understand that:Your content may be visible to others depending on your privacy / profile settings and the features you use (e.g., posts, articles, or group contributions).Other users may view, copy, or use the information you share.By sharing, you grant Support My Community Fundraising permission to display, distribute, and use the content in accordance with your selected privacy and profile settings and our policies. You agree and acknowledge that Support My Community Fundraising is under no obligation and reserves the right not to publish your content or profile for any reason. Additionally, your acknowledge and agree that Support My Community can terminate any type of membership or service provided at any time at Support My Community’s sole discretion. 5. Your License to Support My Community Fundraising5.1 You retain ownership of all original content you provide to Support My Community Fundraising, but you grant us a non-exclusive license to use it.5.2 We respect your content and profile information including its use in advertising.Terminating the License:You can end this license for specific content by deleting it from your Profile, Services or by closing your account, except:a. When the content has been shared with others who have copied, re-shared, or stored it.b. If the content was sublicensed to others before your account closure or content deletion.c. Where laws require us to retain or share it.Note that content and profile removal may take time due to backup systems.Advertisements:Your content will not be included in advertisements for third-party products or services without your explicit consent.However, advertisements may appear near your content or profile without compensation to you.Audience Settings:You agree and acknowledge that as long as your profile is active it, and its content will be available to the general public unless removed by yourself or Support My Community Fundraising.Content may be visible outside of Support My Community Fundraising, re-shared on third-party platforms, or indexed by search engines.Content Editing:We may modify your content for technical reasons (e.g., resizing images, translating text, or changing file formats), but we will not materially alter its meaning.Because you retain ownership of your content, you are free to license it to others, including under Creative Commons terms.5.1 Use of Personal DataAll content that includes personal data is subject to our Privacy Policy. By using our Services, you agree that we may access, store, process, and use the information you provide in line with our Privacy Policies.5.2 FeedbackBy submitting feedback or suggestions about our Services, you allow Support My Community Fundraising to use, share, and act on it for any purpose without compensation to you.5.3 Content ResponsibilityYou agree to:Only provide content that you have the legal right to post or share.Ensure that your content does not violate any laws or infringe on others' rights, including intellectual property rights.Additionally, any information shared on your profile must be truthful. We may be required to remove certain content in accordance with applicable laws.6 Service Availability6.1 Support My Community Fundraising may modify or limit the availability of certain features or discontinue services entirely at our sole discretion.6.2 Support My Community Fundraising does not guarantee the storage or continued availability of any content or information you share or post on your profile. Our platform is not a storage service. Except where required by law or outlined in our Privacy Policy, we have no obligation to store or provide you with a copy of your content.7 Third-Party Content, Sites, and Apps7.1 Third-Party Content:You may encounter inaccurate, incomplete, or harmful content shared by others on our Services. We are not responsible for such content, even though we strive to monitor for misuse.7.2 Third-Party Products and Services:Our Services may connect you with opportunities or services offered by other members or organizations. We are not responsible for the quality, performance, or delivery of these third-party products or services.Support My Community Fundraising does not supervise or control these interactions, and you agree that we:Are not responsible for third-party offers or their performance.Do not endorse specific offers or services.Are not acting as an agent or intermediary for employment or service opportunities.8 Limitations on Use8.1 Support My Community Fundraising reserves the right to limit your access to certain features, restrict your ability to connect with others, or terminate your account at our sole discretion or if you violate this agreement, applicable laws, or our Community Guidelines.We may also remove content that violates our policies or terms or for any reason at our sole discretion. 9 Intellectual Property RightsSupport My Community Fundraising retains all intellectual property rights related to our Trademarks, logos, and services displayed on our platform.10 Limitation of Liability10.1 No WarrantyThis section explains our legal disclaimer regarding the quality, safety, and reliability of our Support My Community Platform or any of our Services.Support My Community Fundraising and its affiliates make no guarantees about the Support My Community Fundraising Platform regarding performance or reliability, including uninterrupted or error-free functionality. The Services, including any content or information, are provided on an "as is" and "as available" basis. To the fullest extent allowed by applicable law, Support My Community Fundraising and its affiliates disclaim all implied or statutory warranties, including but not limited to warranties of title, accuracy of data, non-infringement, merchantability, or fitness for a particular purpose.10.2 Exclusion of LiabilityThese are the legal limits on the liability we may have to you.To the maximum extent permitted by law (and unless a separate written agreement overrides these terms), Support My Community Fundraising and its affiliates will not be liable for:Lost profits or business opportunities.Harm to reputation (e.g., offensive or defamatory statements).Loss of data (e.g., downtime, changes to your information, or content loss).Any indirect, incidental, consequential, special, or punitive damages.10.3 Basis of the Agreement; ExceptionsThe limitations of liability outlined here form a foundational part of the agreement between you and Support My Community Fundraising. These apply to all types of claims, including those based on contract, negligence, tort, or other legal grounds, even if we were informed of the potential for such damages or if the remedies fail in their essential purpose.11 TerminationBoth you and Support My Community Fundraising may terminate this agreement at any time with notice to the other party. Termination can be immediate or subject to a reasonable time frame of 30 days. It is up to Support My Community Fundraising to determine of termination will be immediate or withing the reasonable time frame outlined in this section.Upon termination, your right to access and use the Services ends immediately. The following provisions will remain in effect after termination:Our right to use and disclose your feedback.Any financial obligations or incurred before terminationIf you are a Merchant / Business you agree to fulfill all orders for gift cards placed before voluntary termination or termination by Support My Community Fundraising. You agree that non fulfillment of any orders is in breach of this Agreement / Contract and Support My Community Fundraising is entitled to recover the dollar amount of gift certificates outstanding from you to refund any purchasers of such gift certificates. You agree that any and all legal fees in recovering such monies incurred by Support My Community Fundraising will be your responsibility to pay as well.12 Governing Law and Dispute ResolutionDisputes will be resolved exclusively in the federal or state courts of the state of Maryland. You and Support My Community Fundraising agree to personal jurisdiction in those courts.12 TermsSeverability:If any provision of this agreement is deemed unenforceable by a court of law, the remaining provisions will remain in effect. Where possible, the unenforceable provision will be adjusted to align with its original intent.Entire Agreement:This agreement, together with any additional terms presented during account creation or when accessing specific features, represents the full agreement between you and Support My Community Fundraising regarding the Services, superseding any prior agreements.Non-Enforcement:Our failure to enforce any part of this agreement does not waive our right to enforce it at a later time.Assignment:You are not permitted to transfer or assign your rights or obligations under this agreement without our consent. We reserve the right to assign this agreement to our affiliates or to a third party acquiring our business without requiring your consent.Third-Party Beneficiaries:This agreement does not create any rights for third-party beneficiaries.Legal Notice:All legal notices must be directed to Support My Community Fundraising at the following address:757 Frederick Rd, Suite 301, Catonsville, MD 21228.13. Support My Community Fundraising: Guidelines for UseSupport My Community Fundraising is a platform designed to foster meaningful connections for fundraising and community initiatives. To ensure a safe, respectful, and effective environment, we have outlined the following "Dos and Don’ts" in alignment with our Community Guidelines. These rules define acceptable use of our platform unless explicitly permitted through a formal agreement with Support My Community Fundraising.13.1. What You Should DoBy using Support My Community Fundraising, you agree to:Follow all applicable laws and regulations, including but not limited to privacy laws, intellectual property rights, anti-spam laws, export control regulations, and rules governing shared content.Provide accurate and truthful information about your identity and contact details, and ensure your information remains current.Use your actual name when creating a profile to maintain authenticity and trust within the community.Engage with the platform in a responsible and respectful manner, ensuring your actions align with the purpose of community-driven support.13.2. What You Should AvoidWhen using Support My Community Fundraising, you agree not to:Create or use false identities, impersonate others, make profiles for anyone other than yourself, or access someone else’s account without their permission (e.g., sharing login credentials).Use unauthorized tools or automated processes such as bots, scripts, or web crawlers to collect, scrape, or extract data or content from the platform.Tamper with or bypass platform security features or usage limitations, including controls related to search results, access permissions, or content visibility.Copy, distribute, or share content from the platform without obtaining consent from the rightful owner, including proprietary materials owned by Support My Community Fundraising.Disclose private or confidential information without proper authorization, such as sensitive details about your employer or other parties.Violate intellectual property rights, including copyrights, trademarks, patents, or trade secrets. For instance, do not copy or redistribute content from others without their permission unless explicitly licensed for sharing.Infringe upon the platform's intellectual property, including:Reproducing or redistributing proprietary content such as training resources.Misusing the Support My Community Fundraising name, logos, or trademarks in any business name, email, or web address without prior approval, as detailed in our Brand Guidelines.Upload harmful or malicious software, such as viruses, worms, or other damaging code, onto the platform.Attempt to reverse engineer or manipulate the platform’s technology to uncover source code or disrupt functionality.Falsely claim affiliation with or endorsement by Support My Community Fundraising without explicit approval. For example, do not present yourself as an official representative or partner unless authorized.Sell, rent, or trade access to the platform or its content without explicit written consent from Support My Community Fundraising.Deep-link to specific areas of the platform for unauthorized purposes, unless promoting your campaign or community group.Use bots or similar methods to automate actions such as sending messages, interacting with posts, or creating fake engagement.Mimic or replicate the platform’s design or features, such as by framing or mirroring its content.Modify the platform’s appearance or functionality, such as by inserting unauthorized elements or removing advertisements.Disrupt the platform’s operations, such as by overloading its systems through spamming, denial-of-service attacks, or algorithm manipulation.Engage in activities that violate our Community Guidelines, third-party terms, or specific rules for particular features or services offered by the platform.Use the platform for illegal, deceptive, or unethical purposes, including fraud, discrimination, or spreading false information.Abuse reporting tools or appeals systems, such as by filing false, duplicate, or frivolous complaints.By adhering to these guidelines, you contribute to a secure, trustworthy, and collaborative community on Support My Community Fundraising. Failure to comply with these rules may result in legal action, account suspension or other corrective actions.
